Copyright Policy (DMCA)

Publishing note: paste this into WordPress at https://myvideo.email/dmca/ (the app’s /dmca route 307-redirects there, like /terms and /privacy). Publish it BEFORE deploying the app change, or the redirect lands on a 404. The designated-agent block must match the Copyright Office directory exactly (packages/shared/dmca.ts holds the same values for the app and emails) — change the registration first, then both places. Have counsel review before publishing, like the Terms.

MyVideoEmail (operated by Box Out Marketing Inc) respects the intellectual property of others and expects its users to do the same. Our Terms of Service prohibit uploading or sending content you don’t have the right to use. We respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. §512.

We don’t pre-screen the videos our users record or upload. When we receive a valid notice, we remove or disable access to the material it identifies, notify the user who uploaded it, and follow the counter-notice process described below.

Reporting copyright infringement

The fastest way to send a notice is our online form: https://app.myvideo.email/report?kind=copyright. You can also send a written notice to our designated agent (details below). Under 17 U.S.C. §512(c)(3), your notice must include:

      1. Your physical or electronic signature, as the copyright owner or a person authorized to act on their behalf.

      1. Identification of the copyrighted work you claim has been infringed (or a representative list, if several works are covered by one notice).

      1. Identification of the material you claim is infringing, with enough information for us to find it. A link to the video’s watch page is best.

      1. Your name, mailing address, telephone number and, if available, email address.

      1. A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.

      1. A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on the owner’s behalf.

We may be unable to act on a notice that is missing any of these elements. Before sending one, consider whether the use may be a fair use or otherwise permitted.

What happens after we receive a notice

We review each notice promptly. If it is complete, we disable public access to the identified video: its watch page stops playing it, and it can’t be sent again. We then email the user who uploaded it with a copy of the complaint and instructions for sending a counter-notice.

    Counter-notices

If you believe your video was removed by mistake or misidentification, you can send a counter-notice to our designated agent. Under 17 U.S.C. §512(g)(3), it must include:

        1. Your physical or electronic signature.

        1. Identification of the material that was removed and where it appeared before it was removed.

        1. A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.

        1. Your name, address and telephone number.

        1. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which Box Out Marketing Inc may be found), and that you will accept service of process from the person who sent the original notice or their agent.

When we receive a complete counter-notice, we send a copy to the person who sent the original notice, including your name and contact details. Unless they tell us, within 10 business days, that they have filed a court action seeking to restrain the alleged infringement, we restore the material 10 to 14 business days after we received your counter-notice.

      Repeat infringers

We terminate, in appropriate circumstances, the accounts of users who repeatedly infringe copyright. An account that is the subject of 3 valid copyright notices will ordinarily be terminated. A notice stops counting if the material is restored after a counter-notice, the notice is withdrawn, or we find we removed it in error. We may also terminate an account sooner where the circumstances warrant it.

      Misrepresentations

Under 17 U.S.C. §512(f), anyone who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake or misidentification, may be liable for damages, including costs and attorneys’ fees. If you’re unsure whether material infringes your rights, consider asking a lawyer before sending a notice.

      Other problems with a video

To report a video for something other than copyright (spam, harassment, illegal content or a privacy violation), use the report form at https://app.myvideo.email/report, or the “Report this video” link under any video.
